Supplier Reporting Obligations

Reporting Obligations – Office of Public Integrity

As a supplier contracted to deliver goods, services or a construction project on behalf of the Department for Infrastructure and Transport, you are considered a public officer under the Independent Commissioner Against Corruption Act 2012 (ICAC Act) and have obligations to report any reasonable suspicion of corruption.

Under the ICAC Act you are required to report any reasonable suspicion of corrupt public administration conduct to the Office for Public Integrity. This includes public officers breaching their duty to act honestly in their role at all times, and:

  • abuse of public office
  • bribery or corruption of public officers
  • threats of reprisals against public officers
  • demanding or requiring a benefit on the basis of public office
  • offences relating to the appointment of any public office.

Information on what constitutes reasonable suspicion can be found on the Office for Public Integrity website.

You are strongly encouraged to report maladministration and misconduct to the Office for Public Integrity if the misconduct meets the following criteria:

  • the public officer’s breach contravened a code of conduct
  • the breach was intentional and serious
  • the breach happened while acting in their capacity as a public officer
  • the public officer’s breach could result in disciplinary action.

For further information on your reporting obligations, please refer to the Office for Public Integrity Directions and Guidelines for Public Officers.

Reporting Obligations – Departmental

In addition to the required reporting to the Office of Public Integrity, the Department’s Office of the Chief Executive should be informed where serious misconduct and suspected corruption has been identified or where a supplier believes a Departmental employee has breached the Code of Ethics for the South Australian Public Sector.

Your contract may also involve additional reporting requirements. For further information on this, please contact your contract manager.
